Additional Allegations of Professional Misconduct Against Sean Hart Concern Dominelli Billboard

Every holder of a licence, temporary licence, provisional licence or limited licence who provides to the public a service that is within the practice of professional engineering shall sign, date and affix the holder’s seal to every final drawing, specification, plan, report or other document prepared or checked by the holder as part of the service before it is issued.

Issues are mounting for CBS Outdoor’s embattled structural engineer. Last week in Sean Hart, CBS Outdoor’s Engineer, To Face Allegations of Professional Misconduct Over 346 Dupont Street we told you about the initial allegations of misconduct he is facing. Now there are more.

In early 2008, IllegalSigns.ca filed a complaint against Sean Hart, CBS Outdoor’s Professional Engineer, with respect to former City Councillor Fred Dominelli’s ground billboard on Front Street Extension land at 149 Dufferin Street:

The issue that IllegalSigns.ca complained about was rejected by investigatory staff at the Professional Engineers of Ontario, after the PEO obtained documents from the City of Toronto which were not disclosed (but ought to have been disclosed) to IllegalSigns.ca pursuant to a Freedom of Information request that we filed.

However, during their investigation into the engineering work for the Dominelli sign, the PEO’s own investigatory engineers discovered additional information, completely unknown to IllegalSigns.ca, which has formed the basis of the allegations of professional misconduct which Sean Hart now faces. To wit, PEO staff discovered that Sean Hart submitted certain engineering calculations for Dominelli’s sign without affixing his P.Eng. stamp to the calculations. We didn’t even know that could be an offence.

We are therefore grateful for the diligent work of PEO Staff, work that has caused these possible acts of professional misconduct to face adjudication:

The two new allegations that he is facing are as follows:

  • He Breached Section 53 of Regulation 941/90 made under the Professional Engineers Act by failing to apply his seal to various documents and;
  • He Acted in an unprofessional manner

None of the allegations against Sean Hart with respect to either 346 Dupont or 149 Dufferin have been proven in a court or tribunal.
