1747 and 1661 Eglinton West: Yet Another Buildings Department Screw-Up in the City of York

As readers of this blog are keenly aware, the City of York signs by-law prohibits the erection of a new billboard unless an existing billboard is removed. Unfortunately, the City of Toronto Buildings Department is improperly not requiring the removal of an existing billboard before clearing the inspection of a new sign. As a result, the billboards that are required to be removed in the City of York Cap aren’t being removed.

Today we take a look at 1747 and 1661 Eglinton Avenue West.

Firstly, the sign at 1747 Eglinton West is illegal because it did not comply with the 91-metre separation-of-signs requirement. So the permit for 1753 Eglinton West ought not to have been issued.

But in any case, let’s look at 1661 Eglinton. In August 2008, a local resident complained about this sign to City Councillor Howard Moscoe. Municipal Licensing and Standards informed Councillor Moscoe that the sign at 1661 Eglinton used to be on the roof of 1753 Eglinton Ave. West. Under permit 03 176146 SGN 00 SP, issued October 3, 2003, it was relocated to 1661 Eglinton Ave. West. This permit was cleared on March 17, 2005, as being in compliance with the regulations.

Despite MLS’s claim that the the sign was relocated, the sign was never relocated and the original sign at “1753 Eglinton West” is still there and was never moved. (In fact, there was never a sign at “1753 Eglinton West”; the sign was always located next door at 1747 Eglinton Avenue West. Pattison gave the wrong address to the City, along with the right permit for 1747 Eglinton.)

Furthermore, the sign at 1661 Eglinton West does not comply with the 91 m separation requirements for the City of York. In addition, it does not comply with the maximum size for a roof sign. Nevertheless, all this non-compliance was blatantly ignored by the Buildings Department, which allowed Pattison to keep the illegal billboard on March 17, 2005, when it cleared the permit.
Additionally, the original sign at 1753/1747 Eglinton West is itself not a lawful sign, having been built in violation of 91 m separation-of-signs requirements. Therefore that sign was not entitled to be relocated to a new location.
