Illegal Cieslok Backlight: Wellington and Peter Street

Back in the day, the day Danny Starnino still lives in, third party ground signs were required to be separated from third party pedestal signs by 15 metres, but the separation requirement did not apply to signs on different street frontages. That by-law was changed in the early 1990s, so that by 1994, when Starnino wanted to build a ground sign at Wellington and Peter for Cieslok Outdoor, third party ground signs were required to be separated from third party pedestal signs by 15 metres, but the law didn’t apply to signs that face different streets.

The Cieslok Backlight in the photo above is located, and is unlawfully permitted to be located, within 15 metres of the four-sided Pattison pedestal sign on the Peter Street frontage of lot. The Pattison sign, which was originally permitted under permit 89-286120 in 1989 (and again permitted with a variance under permit 05-175083 in 2005 for the new format, in the exact same spot) faces four directions because it is four sided. It therefore faces any street that the Cieslok backlight faces.

When Danny Starnino applied to obtain a permit for the Cieslok backlight, he attested that the ground sign was not located within 15 metres of any pedestal sign facing the same street:

The diagram that Starnino submitted listed the pedestal sign (”Street Ad”) as “fronts a different street,” as if the old by-law applied. Yet, the notation on the plan written by the Buildings Department states that the sign cannot be located within 15 metres of a pedestal sign facing the same street:

Today, in order to move the Cieslok sign more than 15 metres away from Pattison’s pedestal sign, new concrete would have to be poured, requiring a new building permit.

In addition, notice that the angle of the sign is moved about 90 degrees from the permitted angle so that the sign now faces the same direction asĀ  the Pattison ground sign on the Peter Street frontage, which is 42 metres away. The permit requires the Cieslok sign to be separated by 60M from another ground sign facing the same direction.
