Jim Laughlin Crushes Titan Outdoor Like A Bug

Deputy Chief Building Official Jim Laughlin has filed his affidavit in Superior Court with respect to Titan Outdoor’s suit against the City. Although Laughlin talks about the Building Code way too much to make his affidavit a barn burner, there are a few interesting tidbits. Here it is [PDF]:

Titan Outdoor is arguing that it handles advertising campaigns for the City. Laughlin writes in paragraph 67:

In paragraphs 57 and 58 of his affidavit, Mr. Cieslok indicates that the City has engaged private outdoor advertisers on occasion to promote its programs, services or messages. It would seem from these paragraphs that Mr. Cieslok is suggesting that the City is prepared to ignore the requirements of Chapter 297 or take a different position when the City is somehow involved.

Cieslok gave this PSA for West Nile Virus awareness as example of a City campaign and submitted this photograph of the illegal sign at 76 Church Street:

But Laughlin notes:

Exhibits O and P to Mr. Cieslok’s affidavit include photographs purportedly depicting examples of City campaigns handled by Titan. It should be pointed out that of the three photographs depicted, two are not in fact City campaigns. The photograph in Exhibit O (which is also the second photograph in Exhibit P), depicts a campaign of the Province of Ontario respecting West Nile Virus at the property known as 76 Church Street. The provincial logo can be seen thereon.
