TTC Does Not Face Adverse Posession over 14 Roncesvalles
On August 30, 2007 we wrote A Massive Pattison Outdoor Expressway Billboard at 14 Roncesvalles is Illegal Because it is in Violation of a 1957 By-Law. We then discovered that the sign was encroaching upon a TTC right-of-way and that the encroachment agreement has expired and wrote about it in Adverse Possession and 14 Roncesvalles: Does Pattison Outdoor’s Illegal Billboard have Squatters’ Rights over TTC Property?. We have heard from the TTC. Pattison continues to pay an encroachment fee of about $4000/year for the billboard. Mr. Webster’s letter:

We would like to thank the TTC for looking into the matter. Our next step on the TTC front is to get the TTC to end the encroachment agreement for the illegal sign. But first we want to get the City to enforce the 1957 by-law. It may very well be illegal for the TTC to maintain an encroachment agreement for an illegal billboard. We’re researching that right now. Stay tuned.
