Spotted: Attempted Legalization at 984 Bay Street

Titan Outdoor is attempting to legalize its illegal fascia sign operating under a non-conforming mural permit at 984 Bay Street by way of using the illegal sign as a stencil to create a legal mural.

Here’s Titan’s problem. This wall has this mural permit, issued in 1995, which permits 250 square metres of painted signage. The current by-law restricts painted murals to 100 square metres. This permit is therefore non-conforming.

The Buildings Department has ruled that when a non-conforming sign is removed, signage rights to that sign are lost. It is without a doubt that the painted mural on this wall was removed - see this photo. We believe that Titan therefore does not have the right to paint a 250 square metre sign on this wall. We are asking Buildings to rule on this matter. Buildings has never made such a decision with regards to a painted sign that has no structure. If Buildings rules in our favor, Titan will be able to obtain a permit for a 100 square metre non-illuminated painted sign under the current signs by-law and will lose 150 square metres of signage rights.

We also tracked 984 Bay Street in Ad Nauseam: Three Dimensional Billboards. The permit for 984 Bay was issued at a time when painted signs needed to be 60M away from other third party signs. We are investigating possible non-compliance with 60M separation.
